A former Mayor of Waterford is being taken to the High Court by Waterford City and County Council.
Fine Gael Councillor Declan Doocey is facing the case in relation to his recycling company in Lismore.
Waterford Council has taken the case against the Lismore councillor for alleged breaches of the Waste Management Act.
Mr Doocey, with an address at Ballinraha, Lismore, Co Waterford, has run a farm plastic recycling company based near the town since 1999.
Waterford Council said it was pursuing the case under sections 57 and 58 of the Act and that it would be providing no further comment.
Those two sections of the Waste Management Act relate to the unauthorised holding, recovery or disposal of waste in a manner which may have caused environmental pollution.
Remedies provided for the under the Act include directing the owner of a site to discontinue the holding of waste.

Declan Doocey declined to comment to WLR News or the Sunday Times newspaper. However, he reportedly denied any wrongdoing to the Sunday Independent newspaper and claimed the council was playing hardball with him due to his position. He also claimed he had evidence to show he had sought to remedy the issue in recent years and was confident he would clear his name.
Declan Doocey has been a Fine Gael councillor since 2004, serving a term as mayor of Waterford in 2018-2019, and was comfortably reelected for the Lismore District last year.
The case is due to appear before the High Court on Monday 19th October.
