
The delay in determining a decision on an application which could potentially provide up to 218 homes in Dungarvan has been determined as ‘regrettable’.
An Bord Pleanála had in 2022 permissioned a development of 218 homes at Duckspool, Dungarvan – despite a recommendation of rejection from Waterford City & County Council at the time.
That development was eventually quashed at High Court level – however, the application has been resubmitted by and is currently before An Coimisiún Pleanála for consideration.
The application was lodged by Michael Ryan on February 11th and seeks to construct 218 residential homes – made up of 176 homes and 42 apartments at Duckspool, Abbeyside, Dungarvan.
A decision on that proposed development was expected on or before June 3rd of this year – however, no decision has yet been made and the case is listed as live at present.
In a statement issued to WLR News, An Coimisiún Pleanála said: “This is still a live case and no further information request has issued on the case. This is a Strategic Housing case that has been remitted from the High Court to the Commission for further determination and as such, it does not have a definitive date for decision. The case is currently with an Inspector awaiting the completion of a report and recommendation to the Commission. As soon as the inspector’s report is received, the file will go to the Commission for its consideration and decision.”
A spokesperson for the Strategic Infrastructure Development team at An Bord Pleanála added: “Unfortunately, the Commission is not in a position to specify a timeframe for the making of a decision on this application at this time. The delay in determining the application is regretted.”
On account of the fact that this is a court-remitted case, it does not follow the standard 16-week statutory decision timeline that would normally apply to SHDs. The timeline is now indeterminate, depending on when internal steps are completed.
