A planning application for the construction of almost one hundred new homes at Ballinakill has been refused by Waterford City and County Council.
The application had sought permission for the construction of forty-five detached and semi-detached houses and forty-five self-contained apartments.
The application - submitted by Sanpol Developments Limited was refused for six reasons.
It was deemed that the location of the proposed development would exacerbate the risk of flooding within the site and increase the risk and consequences of flooding elsewhere.
It was noted that the proposed residential development is partially located on lands which are zoned for Open Space and Recreation and lands zoned for High Amenity use.
It was considered that the proposed apartment building would have an overdominant impact on the surrounding area.
Additionally, it was found that the development would be contrary to Ministerial guidance and the proper planning and sustainable development of the area due to its layout and design.
Meanwhile, it was stated that the developer failed to demonstrate that the proposal would not have the potential for adverse impacts on the Lower River Suir Special Area of Conservation.
The sixth reason for the refusal of the application centered on the potential impact on the biodiversity value of the site.
